Probate

When an individual fails to comply with the orders of a court, as it relates to Probate matters, it usually results in a Capias being issued. This Capias can derive from Contempt Orders, Child Support Enforcement, or other matters the Probate Court feels warrants a Capias of an individual.

Physical Apprehension

Based on the complexity of Probate matters and the requirement of the Officers on scene, SCCO does not offer Surrenders on Probate Capias matters.  SCCO moves right to Physical Apprehension on matters of Probate Capiases.

Within 48hrs of SCCO receiving the capias we will complete a Due Diligence Search of the defendant. We will locate the defendant, ensure current address as well as possible alternative address(es) for the defendant and coordinate a date and time with the Attorney/Plaintiff on the intended apprehension and delivery to the appropriate court.  SCCO will always work closely with the Attorney/Plaintiff on scheduling, as well as to NOT exceed the retainer or fee amount, without express approval of the Attorney/Plaintiff.

Once the defendant is apprehended he/she will be transported to the respective court.  Our Constable’s will stay with you and the defendant until a resolution is made.  The cost of the Apprehension is the responsibility of the Attorney/Plaintiff and any reimbursement request needs to be conveyed to the Judge by the Attorney/Plaintiff.
